INFORMATION

  • 1.1 European Natural Additives S.L. (hereinafter, “ENA”), a company of Spanish nationality, with C.I.F. B86598083 and domiciled in Plaza Santa María Soledad Torres Acosta, 1 – 4ª Planta 28004 Madrid (Spain), registered in the Mercantile Registry of Madrid, Volume 30.560, Folio 118, Section 8, Page M-550014, Inscription 1, informs users who access or use the services, applications, tools and, in general, contents included in www.naturaladditives.eu (hereinafter, the “Website”) of the conditions applicable to access and navigation through it.

2. USE OF THE WEB SITE

  • 2.1 By simply browsing and/or using the Website, you acquire the status of user of the same. Browsing the Web Site and the use of the same means your acceptance as a user of each and every one of these conditions of use, as well as the particular conditions, if any, governing the use of the Web Site or the services linked to it.
  • 2.2 ENA may, at any time and without prior notice, modify the presentation and configuration of the Web Site, as well as the conditions required for its use. Said modifications will be published on the Web Site so that the user may be aware of them before proceeding with their use. The use of the Web Site once the conditions of use have been modified will mean the acceptance by the user of the conditions thus modified.

3. WEBSITE USERS

  • 3.1 By using the Website, you represent and warrant that you are at least eighteen years of age. In order to use the Website, minors must obtain prior permission from their parents, guardians or legal representatives, who will be held responsible for all acts performed by minors in their care.

4. PERSONAL DATA PROTECTION POLICY.

  • 4.1 ENA fully complies with the legislation in force regarding the protection of personal data, so that it incorporates the necessary technical and organizational measures for the security of its data in accordance with the provisions of Royal Decree 1720/2007, of December 21, which approves the Regulation for the development of the Organic Law 15/1999.
  • 4.2 The data provided by the user in the course of browsing and using the Web Site will be included in a file for which ENA, domiciled at Plaza Santa María Soledad Torres Acosta, 1 – 4ª Planta 28004 Madrid (Spain), is responsible.
  • 4.3 The data thus provided and those derived from browsing will be processed by the aforementioned company to facilitate access to the Website as well as to manage the services requested, study the information derived from such management, improve our services and adapt them to the preferences of users, as well as to keep you informed about updates on our products and services and send you, including by electronic means, information on products and services, own or third parties, related to the publishing, training, gifts, financial, tourism, leisure, insurance and consumer sectors.
  • 4.4 The user may exercise the rights of access, rectification, opposition and cancellation by means of a written and signed request addressed to the following address: ENA with address at Plaza Santa María Soledad Torres Acosta, 1 – 4ª Planta 28004 Madrid (Spain). Said request must contain the following data: name and surname of the user, address for the purpose of notifications, and photocopy of the national identity card or passport.
  • 4.5 ENA informs users that it may use cookies when a user browses the Website. The user has the possibility of configuring his browser to be warned on screen of the reception of cookies and to prevent the installation of cookies on his hard disk. Please consult the instructions and manuals of your browser for further information ENA will use cookies in order to facilitate navigation and offer a personalized and more agile service. Cookies are small text files that the server inserts in the folder preconfigured by the operating system of the user’s computer to identify him/her. The cookies installed by ENA are associated exclusively with anonymous user profiles, without allowing access to personal data or data stored on the hard disk of the user’s computer.

5. OBLIGATIONS OF THE USER

  • 5.1 The user undertakes, in general, to use the Web Site diligently, in accordance with the law, morality, public order and the provisions of these conditions of use, and shall refrain from using the Web Site in any way that may prevent, damage or impair its normal operation and enjoyment by the users or that may harm or cause damage to the property and rights of ENA, of other users or, in general, of any third party.
  • 5.2 The user guarantees that the information, including personal data, provided to ENA shall be truthful and undertakes to inform ENA of any modification thereof, keeping it updated at all times.
  • 5.3 The user shall be liable for damages of any nature that ENA may suffer directly or indirectly, as a consequence of the breach of any of the obligations derived from these conditions in relation to the use of the Web Site. Likewise, the user shall hold ENA harmless against any sanction, claim or lawsuit that may be filed by a third party, including any public bodies, against ENA, its employees, distributors or agents as a consequence of the violation of any third party rights by said user through the use of the Web Site.
  • 5.4 In addition, and without this enumeration limiting the general scope of the obligation set forth in the preceding paragraph, the user undertakes in the use of the Website to:
    • (a) Not to introduce or disseminate information that is defamatory, libelous, obscene, threatening, xenophobic, incites violence or discrimination based on sex, race, ideology or religion or that in any way violates morality, public order, fundamental rights, public liberties, honor, privacy or the image of third parties and, in general, current legislation.
    • (b) Not to introduce, store or disseminate through the Web Site any computer program, data, virus, code or any other electronic or physical instrument or device that may cause damage to the Web Site, or to any equipment, systems or networks of ENA, of any other user, of its suppliers or in general of any third party, or that may otherwise be capable of causing any type of alteration or impede the normal operation of the same.
    • (c) Not to use false identities or impersonate others in the use of the Web Site.
    • (d) Not to conceal or misrepresent in any way the origin of e-mail messages, not to intercept, delete or modify the e-mail messages of other users, or send mass mailings.
    • (e) Not to destroy, alter, disable or damage the data, information, programs or electronic documents of ENA, its suppliers or third parties.
    • (f) Not to introduce, store or disseminate through the Web Site, any content that infringes intellectual property rights, industrial or business secrets of third parties, or in general any content for which it does not hold, in accordance with the law, the right to make it available to third parties.
    • (g) Not to use the Web Site, the contents and in particular the information obtained through the Web Site, to send advertising, send messages for direct marketing purposes or for any other commercial purpose, or to collect or store personal data of third parties.
  • 5.5 In the event that any user or third party considers that there are facts or circumstances that reveal the unlawful nature of the use of any content and/or the performance of any activity on the Website or accessible through the same, he/she must send a notification to ENA through the “Contact” section or by e-mail info[@]naturaladditives.eu

6. CUSTOMER SERVICE AND COMMUNICATIONS

  • 6.1 For the purposes of these conditions of use, and for any communication that may be necessary between ENA and the user, the user may use the “Contact” section, the e-mail address info[@]naturaladditives.eu or the telephone number 91 7864486. The user expressly accepts for all communications related to the use of the Website, the use of e-mail as a valid procedure for sending such communications.

7. INTELLECTUAL AND INDUSTRIAL PROPERTY

  • 7.1 The user acknowledges that all the elements of the Web Site, the information and materials contained therein, the trademarks, the structure, selection, arrangement and presentation of its contents, and the computer programs used in connection therewith, are protected by intellectual and industrial property rights of ENA or of third parties, and that the use of the Web Site does not grant the user any right other than those specifically contemplated in the Web Site with respect to such industrial and intellectual property rights.
  • 7.2 Unless authorized by ENA or, as the case may be, by the third parties holding the corresponding rights, or unless it is legally permitted, the user may not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, lend, make available, or allow access to the public through any form of public communication of any of the elements referred to in the preceding paragraph. The user must use the materials, elements and information to which he/she accesses by browsing and using the Web Site only for his/her own needs, and undertakes not to make any direct or indirect commercial exploitation of the materials, elements and information obtained through the Web Site.
  • 7.3 The user shall refrain from deleting the signs identifying the rights (of intellectual, industrial property or any other) of ENA or of third parties appearing on the Web Site, as well as from evading or manipulating any technical devices established by ENA or by third parties on the Web Site.
  • 7.4 Under no circumstances shall it be understood that any license is granted or any waiver, transfer, total or partial assignment of such rights is made, nor is any right or expectation of right conferred, and, in particular, of alteration, exploitation, reproduction, distribution or public communication of such contents without the prior express authorization of ENA or of the corresponding owners.

8. PROHIBITION OF HYPERLINKS

  • 8.1 No link may be established to the Website from any other website without the prior express consent of ENA.
  • 8.2 There is no link or relationship between ENA and those users and, in general, those persons who establish a hyperlink between their web page and the Web Site, being the same responsible for all the contents existing in their web page, exempting ENA from any liability it may incur for the illicit contents of the aforementioned web pages.

9. LIABILITY AND DISCLAIMER OF WARRANTIES

  • 9.1 Without prejudice to the liability for damages that may arise, ENA may, immediately and without prior notice, resolve and terminate its relationship with the user or interrupt the user’s access to the Web Site, if it detects a use of the Web Site contrary to these conditions of use.
  • 9.2 ENA shall only be liable for any damages that the user may suffer as a result of the use of the Website when such damages are attributable to the wilful misconduct of ENA. The user acknowledges and accepts that the use of the Website is at the user’s sole risk and responsibility.
  • 9.3 ENA will abide by the security measures generally adopted in the industry to ensure the confidentiality and security of the use of the Website. However, ENA cannot guarantee that unauthorized third parties may have knowledge of the characteristics and circumstances of the use that users make of the Web Site. ENA will act diligently according to the generally accepted uses in the sector to avoid the presence in the Web Site of viruses or other harmful elements that could cause alterations in the user’s computer system, in its electronic documents or in its files, but it cannot guarantee the absence of such elements, and shall not be liable for the damages that this could cause.
  • 9.4 ENA shall not be liable for any damages that may arise from, but not limited to:
    • (i) inferences, omissions, interruptions, computer viruses, breakdowns and/or disconnections in the operative functioning of this electronic system or in the computer devices and equipment of the users, caused by reasons beyond the control of ENA, which prevent or delay the rendering of the services or the navigation through the system;
    • (ii) delays or blockages in the use caused by deficiencies or overloading of the Internet or other electronic systems;
    • (iii) damages that may be caused by third parties through illegitimate intromissions beyond the control of the Web Site and that are not attributable to ENA;
    • (iv) the impossibility of providing the service or allowing access for reasons not attributable to ENA, due to the user, third parties, or force majeure.
  • 9.5 ENA does not control, in general, the use that users make of the Web Site. In particular, ENA does not guarantee that users use the Web Site in accordance with the law, these conditions of use, morality and generally accepted good customs and public order, nor that they do so in a diligent and prudent manner.
  • 9.6 In the event that technical linking devices (such as, among others, links, banners, buttons, etc.), directories and search tools that allow users to access websites belonging to and/or managed by third parties are made available to the users, ENA does not guarantee or assume any kind of liability for damages of any kind that may be due to the operation or accessibility of the linked sites, as well as to the quality, legality and usefulness of the information and contents and services existing in the linked sites.

10. APPLICABLE LAW AND JURISDICTION

  • 10.1 The provisions contained in these Terms of Use shall be governed by and construed in accordance with Spanish law.
  • 10.2 Unless expressly prohibited by law, for the resolution of all disputes arising from these conditions of use, or relating to the breach, interpretation, termination or validity of any provision of the Website, the parties, by mutual agreement, submit to the jurisdiction of the Courts and Tribunals of Madrid, expressly waiving any other jurisdiction that may correspond to them.
